When God created the human being the angels warned God that man is sure to do wrong which will vex the Creator who replied I will be compassionate. Compassion in all the ancient peoples around the globe is considered to highest of human attributes. In Torah law justice far outweighs deterrent and it is justice which is mitigated by compassion.
Once there was a wise man who had three students of whom he asked the same question: if you found a wallet in the street what would you do? The first answered I would give it back to which the wise man replied–fool; the second said he would keep it to which the wise man replied–thief; the third admitted he did not know what he would do because he had yet to be tested.
The human being created in the image of our maker should strive to emulate the kind attributes of the Creator who creates only good; it is the human being through our errant ways that brings discomfort to the world.
The Talmud-Book of Law states that even the righteous cannot stand in the place of the repentant.
